E-Verify Unavailable Due to Government Shutdown

As of October 1, 2025, E-Verify is temporarily unavailable because of a lapse in federal funding and statutory authority. During this time, employers will be unable to enroll in E-Verify, create E-Verify cases, view or take action on any case, add, delete, or edit any user account, reset passwords, edit company information, terminate accounts, run reports, or view any account information. E-Verify customer support, Self Check, myE-Verify, and training sessions are also unavailable.

New Temporary Policies:

USCIS has announced temporary policies to reduce the impact, including:

  1. The “three-day rule” for creating E-Verify cases is suspended until the system reopens.
  2. Employers must still complete Form I-9 within three business days of an employee’s start date.
  3. Deadlines for employees to resolve mismatches have been extended; days during the outage will not be counted against them.
  4. Employers may not take adverse action against employees due to an interim case status.

Further guidance will be provided once E-Verify resumes operations.

Farmer Law PC will continue to monitor developments with respect to these and other policy changes and will post updates as additional information becomes available.
