Premium Processing Fees will increase effective March 1, 2026

The Department of Homeland Security (DHS) announced an Interim Final Rule that increases USCIS fees for Premium Processing (Form I-907, Request for Premium Processing). The rule will apply to applications filed on or after March 1, 2026. The information below provides a comprehensive breakdown of these updates.   

 

USCIS Premium Processing Filing Fee Changes  

 

Form I-129: Petition for Nonimmigrant Workers

Used by U.S. employers to petition temporary foreign nonimmigrant workers: 

    • H-2B and R-1 workers (Temporary non-agricultural workers and religious workers) 
      • Old fee: $1,685 
      • New fee: $1,780 
      • Increase: +$95 

 

    • All other I-129 nonimmigrant visa categories, including, investors (E-1, E-2), skilled workers (H-1B, E-3), trainees (H-3), intracompany transferees (L), individuals with extraordinary ability (O), athletes and entertainers (P), cultural exchange (Q), and NAFTA professionals (TN). 
      • Old fee: $2,805 
      • New fee: $2,965 
      • Increase: +$160 

 

Form I-140: Immigrant Petition for Alien Worker 

Used by employers to sponsor foreign workers for employment-based green cards. 

    • Old fee: $2,805 
    • New fee: $2,965 
    • Increase: +$160 

 

Form I-539: Application to Extend or Change Status 

Used by individuals already in the U.S. to extend or change their nonimmigrant status, including students and exchange visitors (F, J, and M categories). 

    • Old fee: $1,965 
    • New fee: $2,075 
    • Increase: +$110 

 

Form I-765: Application for Employment Authorization 

Used by certain noncitizens to request a work authorization document, including international students on OPT and STEM-OPT. 

    • Old fee: $1,685 
    • New fee: $1,780 
    • Increase: +$95
