H-2A Visa Program

The H-2A visa program is a federal program designed to fulfill labor shortages in the agriculture industry, allowing employers to get an adequate and legal labor force, while also protecting jobs and wages of U.S. workers.

This program allows employers to apply for nonimmigrant alien workers (guest temporary workers) to perform any type of farm work or construction taking place on the farm for up to 10 months a year. Some benefits of the program include:

Ensuring the amount of temporary labor you need for the season.
The workers are sponsored by the company, so you have the security that the workers will be with you for the season at the hourly rate required in your state.
Most states do not require overtime to be paid for agricultural labor.
Maximize your productivity with a stable group of workers.
The H2A visa workers are tax exempt. H-2A workers aren’t required to pay Social Security and Medicare taxes on their wages. In addition, the employer is not required to pay these taxes on the worker either.
