Notice for Annual Food & Subsistence Update

On February 23, 2022, the Employment and Training Administration (ETA) of the Department of Labor (DOL) issued a notice for the Annual Food and Subsistence Update. This notice announces the annual updates on several monetary charges for agricultural workers’ meals and travel subsistence reimbursements.
The new maximum fee for employers seeking H-2A workers who may charge their workers when the employer provides three meals a day has been updated. This is applicable to H-2A employers who are in occupations other than herding or production of livestock on the range. The H-2A program will now have a maximum meal charge of $14.00 per day.
The maximum travel subsistence meal reimbursement for both the H-2A and H-2B programs has also changed. A worker with receipts may claim reimbursement under both programs but will need to provide documentation of actual expenses. The Travel Subsistence Meal Reimbursement is now a minimum of $14.00 and a maximum of $59.00 per day. Finally, this notice includes a reminder regarding employers’ obligations with respect to overnight lodging costs as part of required subsistence.

This is effective on February 23, 2022.
