The TN Visa for Technology U.S Companies

In the technology industry, there is a powerful resource that companies are not utilizing to its fullest potential—the TN visa. This visa, which stands for Trade NAFTA, is available to Canadian and Mexican citizens who wish to work in the United States and offers a fast-track solution to the often cumbersome H-1B visa process. It’s time for technology companies to start taking advantage of this underutilized tool.

What is a TN Visa?

The TN visa was created in 1994 as part of the North American Free Trade Agreement (NAFTA). It allows Canadian and Mexican citizens with certain professional qualifications to be admitted into the U.S. for up to three years at a time to work in specific occupations listed on the NAFTA list, including many professions within the tech industry such as software developers and engineers, computer programmers, systems analysts, web designers and more.

Advantages of Using a TN Visa

The advantages of using a TN visa over an H-1B visa are numerous. For one thing, it is much faster and easier than applying for an H-1B; while it can take months or even years for an H-1B petition to be approved, a Canadian TN application can be processed onsite at the port of entry within minutes or hours depending on individual circumstances. Additionally, there are no annual limits on how many visas can be issued like there are with H-1Bs; if you qualify for a TN visa you will almost always get one quickly and easily! Finally, unlike with an H-1B petition where employers must prove they have made every effort to hire local candidates before hiring from abroad, there is no such requirement with a TN visa so it is much less burdensome for employers as well as employees.
